ewz builds a photovoltaic installation (PV installation) The customer wishes to invest in the PV installation and purchases the solar power that will be generated in the future by this PV installation during the technical lifetime of the PV installation by paying a one-off cost contribution (hereinafter referred to as the ‘price’). The acquired entitlement to solar power is credited to the customer’s electricity bill.
If a customer orders solar power using the ewz order form, they do not yet have any legal claims and no contract has yet been concluded. The contract between ewz and the customer is only concluded when the customer has paid the invoice amount following confirmation by ewz.
Customers can invest in the solar power plant if they meet the following requirements:
The customer must also meet these requirements during the supply period; otherwise delivery will be stopped.
By paying the price, the customer purchases a fixed amount of solar power from a specific PV installation during the term of the contract (hereinafter ‘ewz.solargrischun’).
The fixed quantity of solar power is determined independently of operational factors based on an area in square metres of the PV installation. One square metre of PV installation corresponds to a fixed entitlement to a certain number of kWh of solar power per year during the term of the contract. The number of kWh of solar power that is credited annually is noted on the order form.
ewz supplies ewz.solargrischun with an electricity credit on the customer’s ewz electricity bill at peak tariff times.
If the electricity credit is greater than the consumption at peak tariff times during a billing cycle, ewz will credit the excess volume to ewz.solargrischun at off-peak tariff times.
The fixed quantity of solar power is credited pro rata over the billing cycles.
The credit reduces the total purchase quantity of the standard electricity product selected by the customer for the energy supply.
The purchased quantity of solar power must be deductable from the purchase quantity. If the customer consumes less electricity during a billing cycle overall than the credit entitlement to ewz.solargrischun for that billing cycle, the excess volume is forfeited. If electricity consumption is consistently lower than the credit entitlement to ewz.solargrischun, ewz will repurchase the excess units ordered on request by the customer (only complete square metres).
When ordering ewz.solargrischun, a customer obtains energy from a specific PV installation. They continue to owe the grid usage fee, including all charges.
ewz will provide ewz.solargrischun for 20 years from the time at which the PV installation was commissioned. ewz will specify the commissioning date of the specific installation in the confirmation uniformly for all customers.
ewz will bill the customer for the price of ewz.solargrischun.
The invoice from ewz is payable within 30 days of the invoice date.
If a customer moves within the city of Zurich or within the ewz distribution grid area in the canton of Grisons, they will continue to receive the electricity credit from ewz.solargrischun on their ewz electricity bill.
If a customer moves out of the city of Zurich or the ewz distribution grid area in the canton of Grisons, they have the right to sell their entitlement to future deliveries from ewz.solargrischun in exchange for reimbursement of the buy-back price on the moving-out date. The customer notifies ewz of the move at least 10 days before handing over the keys at ewz.ch/umzug.
The buy-back price is calculated on the basis of the price paid by the customer for ewz.solargrischun and the unexpired term of the contract, i.e. after 10 years, the buy-back price to be paid by ewz is still half of the price originally paid by the customer for ewz.solargrischun.
The customer has the right to terminate their entitlement to future deliveries from ewz.solargrischun in return for reimbursement of the buy-back price subject to a notice period of three months.
In the event of full electricity market liberalisation, ewz has the right to terminate the entitlement to future deliveries from ewz.solargrischun in exchange for reimbursement of the buyback price subject to a notice period of three months as of the date of entry into force of the full electricity market liberalisation.
This contractual relationship is governed by Swiss law. Zurich is the exclusive place of jurisdiction.
